The man charged with attempting to kill someone outside the FedEx World Hub was released from jail without bond.

Tyreese Earnest is charged with attempted second-degree murder, employment of a firearm, reckless endangerment, and vandalism. He was identified as the shooter.

Earnest was originally given a $200,000 bond. However, his bond was later lowered to “released on his own recognizance.”

District Attorney Steve Mulroy says he disagrees with the decision.

In this case, as in many others, we opposed lowering the $200,000 bond initially set by a judicial commissioner AND the release on his own recognizance (ROR) by the judge.

As you know by now, the District Attorney’s office can argue for bond and against ROR, but the judge makes the decision. In this case, the court disagreed with our assessment and recommendations.

Be sure if the defendant violates the terms of release, we will be ready to ask the court to reincarcerate him. As for the case, we will further investigate, build a strong case, and prosecute vigorously.

The shooting happened in the early morning hours of October 30. At the time, FedEx officials referred to the shooting as “accidental.”

Ja‘Marcus Odell and Ja’Marion Odell are also charged with the facilitation of attempted second-degree murder in the case.

According to police, the three were looking inside the victim’s car through his window.

According to the arrest affidavit, the victim and three suspects were all FedEx employees at the time of the shooting. FedEx has yet to respond to Action News 5’s request, asking if the men are still employed.
